Allgemeine Geschäftsbedingungen

1. Für alle auf www.justgetit.ch getätigte Geschäfte gelten ausschliesslich diese allgemeinen Geschäftsbedingungen. Spätestens nach Erhalt unserer Auftragsbestätigung gelten diese Bedingungen als angenommen. Abweichende Bedingungen des Kunden werden nicht akzeptiert und gelten als ungültig.
   
2. Durch die Bestellung online oder per Email kommt zwischen dem Kunden und www.justgetit.ch ein Kaufvertrag zustande. Wir können allerdings ohne Grundangabe innerhalb von 14 Tagen vom Vertrag zurücktreten (z. B. bei Lieferschwierigkeiten eines Produktes). Der vorausgezahlte Betrag wird dann umgehend zurückerstattet.
   
3. Sämtliche Produktangaben sind unverbindlich. Farbabbildungen sind unverbindlich und erheben keinen Anspruch auf Übereinstimmung mit dem Originalprodukt (technisches Problem)
   
4. Sämtliche Preise sind in CHF (Schweizer Franken) pro Stück/Set inkl. Schweizer MWST angegeben. Für die Lieferung wird ein Portozuschlag (im Shop ersichtlich) verrechnet.
   
5. Es können folgende Zahlungsarten gewählt werden:

Nachnahme:
Nur in der Schweiz, bei Nichtabholung verlangen wir einen Unkostenbeitrag von 5 % des Rechnungsbetrages, mindestens jedoch CHF 50.00 plus anfallende Transportkosten

Vorauszahlung:
Sie erhalten in unserer Auftragsbestätigung unsere Zahlungsinstruktionen, es ist der gesamte Rechnungsbetrag zu überweisen, ohne jeglichen Abzug, alle Spesen zu Lasten des Auftraggebers

Kreditkarten:
Wir werden AMEXCO, VISA und MASTERCARD akzeptieren. Die Kreditkartenverarbeitung wird in einer sicheren SSL-Verbindung über das anerkannte Zahlungssystem Saferpay der Firma 3 C-Systems AG abgewickelt. Ihre Daten sind somit sicher gegen Eingriff Dritter geschützt.
   
6. In der Regel verlässt die Bestellte Ware unsere Lager innerhalb von 7-10 Tagen, je nach Destination und Saison kann die Lieferzeit länger dauern. Falls nicht angegeben, erkundigen Sie sich bitte per Mail über die momentane Verfügbarkeit. Bei Lieferzeiten über 4 Wochen erfolgt eine schriftliche Bestätigung mit ungefährem Liefertermin.
   
7. Bei Auslandlieferungen verrechnen wir den mehrwertsteuerfreien Betrag, der Käufer hat zusätzlich die im Lieferland gültigen Steuern und Spesen für Einfuhr- und Zollabwicklung direkt an das zuständige Amt oder mit der Zollabwicklung beauftragte Unternehmen zu bezahlen.
   
8. Die Ware bleibt bis zur vollständigen Bezahlung Eigentum der MIAG, CH-8832 Wilen, diese ist auch berechtigt, einen Eintrag ins Eigentumsvorbehaltsregister vorzunehmen.
   
9. Die Garantiefrist beträgt, falls im Shop nicht anders angegeben, 12 Monate und beginnt ab dem Kaufdatum. Sie gilt nur für Material- und Fabrikationsmängel und erlischt bei unsachgemässem Gebrauch, vorgenommenen Änderungen oder Reparaturen. Es liegt in unserem Ermessen nur das defekte Teil oder auch das ganze Produkt gegen ein gleichwertiges zu Ersetzen.

11. Diese AGB und sämtliche Verträge, die Aufgrund dieser AGB geschlossen werden, unterliegen Schweizerischem Recht. Gerichtsstand ist CH-8832 Wollerau oder ein anderes ausschliesslich von MIAG bestimmter rechtlicher Gerichtsstand.
   
12. Die Unwirksamkeit einzelner Bestimmungen des Vertrages oder dieser AGB, berührt nicht den weiteren Bestand des Vertrages oder dieser AGB.
   
13. Bei unterschiedlichen Auffassungen der Übersetzungen ist ausschliesslich die deutsche Version dieser AGB massgebend.

General business terms and conditions

1. For all business done through www.justgetit.ch only the following general business terms and conditions are valid. The latest, after our order confirmation is received, we regard these conditions as accepted. Any different conditions by the customer are invalid and wont be accepted.
   
2. With an online purchase or order per email a contract is set between the buyer and www.justgetit.ch. We can decline the contract within 14 days without explanation (for example when an article runs out of stock). The payment will be reimbursed immediately.
   
3. All product information are without any obligation. Colours are not necessarly corresponding with the orignal product (technical problem), no claims will be accepted.
   
4. All rates are in CHF (Swiss Francs) per piece/Set incl. Swiss VAT. For delivery we charge an extra fee (viewable in the shop).
   
5. We offer the following payment conditions:

Cash on delivery:
Only to Switzerland, if goods remain uncollected, we charge a fee of 5 % of the invoiced amount for our inconvenience, but at least CHF 50.00 plust additional delivery costs

Prepayment:
You will receive our wire instructions with our order confirmation. We ask you to pay the invoiced amount, no discounts are allowed, all fees and banking costs have to be covered by the customer

Credit Cards:
We will accept AMEXCO, VISA und MASTERCARD. The credit cards will be processed through a secure SSL-connection through the recommended payment system Saferpay of 3 C-Systems AG. Your data is protected against abuse of 3rd parties.
   
6. Usually the ordered products leave our store within 7-10 days, depending on the destination and season our delivery can take longer. If not stated, please inquire our current delivery conditions by email. If the delivery time exceeds 4 weeks, we will inform you by email with an approximative delivery date.
   
7. For deliveries outside Switzerland, we charge the tax-free amount, the buyer will be charged additionally VAT for his country and costs for customs and import payable directly to the related customs office or one of his agents.
   
8. Until complete payment the goods remain property of MIAG, CH-8832 Wilen, who also is allowed to undertake the registration in the registry of property reservations.
   
9. If not stated any different in the shop, the warranty lasts for 12 months, starting from the day of purchase. The warranty is limited at production and material defects, and expires with improper use, unauthorised modification or reparation of the product. It is our decision to repair or exchange the defected part or exchange the product against a new one of the same.

11. This general business terms and conditions and all deals closed in back of these conditions, are under control of Swiss law. Place of jurisdiction is CH-8832 Wollerau or any other selected only by MIAG.
   
12. If some determinations of the contract or these conditions are ineffective, the other parts of the contract or conditions remain valid.
   
13. By different interpretations of the translations of these conditions, only the german one is competent.

Conditions générales de vente

1. Pour toutes les affaires effectués sur www.justgetit.ch seulement les conditions générales de vente suivantes sont valide. Au plus tard après avoir reçu notre confirmation de l' ordre, ces conditions sont accepté. Conditions du client différentes sont pas valides et pas acceptables.
   
2. Avec l' ordination online ou par email le client passe un contrat avec www.justgetit.ch. Nous avons le droit de refuser le contrat sans explications dans 14 jours (pour exemple a cause de problèmes de livraison). Le montant payé verra restitué immédiatement.
   
3. Toutes les informations des produits sont sans engagement. Les couleurs ne correspondent pas nécessairement aux couleurs du produit original.
   
4. Tous les prix sont en CHF (Francs Suisses) par pièce/set IVA Suisse inclus. Pour la livraison nous demandons une frais (voir dans shop).
   
5. Nous offrons les suivants modes de paiements:

Contre remboursement:
Seulement en Suisse, pour livraisons pas pris, nous chargeons une frais de 5 % du montant du compte pour nos menées, mais au moins CHF 50.00 plus frais de transport

Paiement d' avance:
Avec notre confirmation de l' ordre vous recevrez notre instructions de paiement. Envoyez le montant entier sans déductions, tous le frais bancaires a votre dé bit

Cartes de crédit:
Nous accepterons AMEXCO, VISA et MASTERCARD. Les cartes de crédit sont validé par une connexion de sécurité SSL par le system légitimé Saferpay de la compagnie 3 C-Systems AG. Votre dates sont protégé contre abus.
   
6. Normalement les articles commandés laissent notre stock après 7-10 jours, dépendant du destination et de la saison le délai du livraison peut durer plus. Si pas mentionné, veuillez vous informer par email de la disponibilité du article désiré. Délai du livraison plus longue que 4 semaines vous recevrez une confirmation avec un délai approximatif.
   
7. Pour livraisons à l' étranger le prix sera calculé IVA exclus, l' acheteur paie les impôts valides dans sont pays et les frais d' importation et dédouanement directement au bureau compétent de l' importation.
   
8. Jusque au paiement complet, la marchandise sera propriété de la MIAG, CH-8832 Wilen, qui aussi a le droit d' enregistrer dans le registre de réserve de propriété.
   
9. Le délai de la garantie et de 12 mois, si pas mentionné différemment dans le shop et commence avec la date de l'achat. Elle est seulement valide pour défaut de matériel ou de fabrication. Elle perd sa validité après utilisation incorrecte, modifications et réparations pas autorisé. C'est dans notre compétence de réparer ou échanger seulement la pièce défectueuse ou même l' article entier.

11. Ces conditions générales de vente et tous les contrats conclus sous cette conditions, sont dessous la loi Suisse. Lieu de juridiction est CH-8832 Wollerau ou un autre lieu de juridiction choisi seulement par MIAG.
   
12. L' inefficacité d' une ou plusieurs déterminations du contrat ou de cette conditions générales de vente ne touchent pas le reste du contrat ou des conditions.
   
13. S' il y a des différentes interprétations de la traduction de cette conditions générales de vente seulement la version allemande de cette conditions générales de vente seront déterminantes.

Condizioni generali di contratto

1. Per tutti gli affari effettuati con www.justgetit.ch solamente le condizioni generali di vendita qui presenti avranno validità. Al più tardi dopo aver ricevuto la nostra conferma d' ordine queste condizioni si considerano accettate dal cliente. Condizioni del cliente differenti à le qui presenti non sono accettate e non saranno valide.
   
2. Con l' ordinazione online o per email si stipula un contratto tramite il cliente e www.justgetit.ch. Il contratto potrà essere annullato entro 14 giorni da nostra parte senza alcune spiegazioni (normalmente quando arrivano difficoltà di produzione). L' importo pagato in anticipo sarà restituito immediatamente.
   
3. Tutte le indicazioni dei prodotti sono non vincolante. Illustrazioni di colori non danno diritto alla loro corrispondenza con il prodotto originale (problema tecnico).
   
4. Tutti i prezzi sono in CHF (Franchi Svizzeri) per pezzo/set IVA Svizzera inclusa. Per la consegna verrà conteggiato il porto (come indicato nel shop).
   
5. Avete la scelta dei modi di pagamento seguenti:

In contrassegno:
Solamente in Svizzera, per spedizioni non accettate vi debbitiamo 5% del importo del conto, per spese, pero al minimo CHF 50.00 più costi del trasporto.

Pagamento in anticipo:
Riceverete le nostre istruzioni di pagamento con la conferma dell' ordinazione. Dovrà essere pagato il importo totale senza alcuni sconti, costi bancari a debito del committente.

Carte di credito:
Accetteremo carte di AMEXCO, VISA e MASTERCARD. Per la validazione delle carte si usa una connessione sicura SSL tramite il sistema legittimo Saferpay della dita 3 C-Systems AG. I vostri dati saranno protetti contro abusi.
   
6. Normalmente la merce lascia il nostro magazzino entro 7-10 giorni, dipendente da destinazione e stagione la consegna può anche durare più lungo. Se non indicato nel shop, si consiglia di richiedere per email il periodo di consegna. Per consegne oltre 4 settimane dopo l' acquisto vi informiamo della data approssimativa della consegna.
   
7. Consegne al estero saranno conteggiate senza IVA, il cliente dovrà pagare le tasse valide per il suo paese più i costi del importo e sdoganamento à la sua dogana o un altro ufficio incaricato.
   
8. La merce rimane fina al pagamento completo proprietà della MIAG, CH-8832 Wilen, che ha anche il diritto di fare un iscrizione nel registro di riserva di proprietà.
   
9. Il periodo di garanzia e di 12 mesi, se non indicato differente nel shop, e inizia con la data del acquisto. La garanzia perde validità in caso di uso inappropriato, modificazioni o riparazioni non autorizzate. Sarà la nostra decisione di riparare o ricambiare il pezzo difettato oppure di ricambiare il articolo intero.

11. Queste condizioni generali di vendita e tutti gli contratti effettuati a base di queste condizioni, sono soggetto à la legge Svizzera. CH-8832 Wollerau sarà il foro competente giurisdizionale, solamente MIAG può scegliere un foro giurisdizionale differente.
   
12. L' inefficacità di singole regole del contratto o delle condizioni generali di vendita non cancella la validità del resto del contratto o delle le condizioni generali di vendita.
   
13. In caso di interpretazioni differenti della traduzione di queste condizioni generali di vendita solamente la versione tedesca di queste condizioni sarà valida.
